A 35-year-old man has been handed a thirteen years imprisonment sentence after the court found him guilty, on 23rd September 2020, of sexually penetrating a minor contrary to law.
Alimamy Conteh who resides at 30 Hook Street, east of the capital Freetown, allegedly grabbed the victim, undressed and penetrated her forcefully in a nearby house, according to the testimony of the victim in Court. The incident, according to the particular of offence, occurred on the 25th January 2018. The victim was returning home from a private conducted lesson school when she met the accused in a local rum bar.
A medical report to the effect states that there were no physical injuries seen but the hymen was completely ruptured and there was yellowish discharge from the vagina.
Four witnesses for the prosecution testified including the Medical Doctor. The accused was represented by Lawyer Mamakoh Kallon who told the Court that he relied on his statement to the police.
Delivering her verdict, Justice King said the prosecution secured unshaken evidence during the cross-examination stage and as such were able to prove their case beyond all reasonable doubts upon which the accused has been found guilty of the offence. Sexual penetration contravenes Section 19 of the Sexual Offenses Act of 2012, No. 12 of 2012.
Justice King on 23rd September, 2020 sentenced the accused to thirteen (13) years imprisonment including time already spent in detention.
