"Kenyan Supreme Court Judge Elected Vice President of Residual Special Court for Sierra Leone"

Honorable Justice Isaac Lenaola, a distinguished member of the Kenyan Supreme Court, has been elected as the Vice President of the Residual Special Court for Sierra Leone (RSCSL). This prestigious appointment was announced on February 29th, during the Court's Plenary session held in Freetown, Sierra Leone.

 

Justice Lenaola's election to this significant role was a unanimous decision by the Court members. His extensive experience and unwavering dedication to justice were cited as key factors that made him an ideal candidate for this position. As the Vice President, Justice Lenaola will serve as the deputy to Justice Richard Lussick of Samoa, who was elected as the President of the Court for a two-year term.

 

Justice Lenaola's tenure at the RSCSL is expected to be marked by a continuation of the Court's critical functions. These include:

 

1. Witness Protection and Support: The RSCSL is responsible for responding to threats related to testimony given before the Special Court for Sierra Leone (SCSL) and providing appropriate protection and support measures. The Court has witness protection officers located in Freetown to ensure the safety and security of individuals involved in court proceedings.

 

2. Assistance to National Prosecution Authorities: The Court manages governmental requests for evidence and information to support investigations, prosecutions, forfeiture proceedings, and asylum cases. It upholds confidentiality obligations while ensuring the smooth flow of information between national and international authorities.

 

3. Supervision of Prison Sentences/Pardons/Commutations/Early Releases: The RSCSL oversees the enforcement of sentences, including the inspection of imprisonment conditions, tracking time served, and managing dates of release. This supervision extends until 2055, involving cases such as the former President of Liberia, Charles Ghankay Taylor.

 

4. Trial of Johnny Paul Koroma: The Court has jurisdiction to try Koroma if he is arrested after the closure of the Special Court. The RSCSL will also make efforts to refer the case to a competent national jurisdiction for trial if not done before the Special Court's closure in 2012.
